Legalization of documents

Consular legalization of documents.

Consular legalization of documents is a procedure for giving legal effect to a document issued in the territory of one state for the purpose of its use in the territory of another state.

Important information! Legalization of a document is always carried out in the territory of the state in which it was issued and/or drawn up only.

Scheme (procedure) of consular legalization of documents drawn up in the territory of the Kyrgyz Republic:

  1. State notary office of the Kyrgyz Republic (certifies accuracy of the copy of document and, subject to availability of the document translation into a foreign language, then translator's signature);
  2. Administration of Notaries and Advocates of the Ministry of Justice of the Kyrgyz Republic (certification of the signature and seal of the notary);
  3. Consular Department of the Ministry of Foreign Affairs of the Kyrgyz Republic (carrying out of consular legalization);
  4. A diplomatic mission accredited in the Kyrgyz Republic or a consular office of a foreign state,on which territory documents will be used, or a diplomatic mission or a consular agency of the Kyrgyz Republic accredited in a foreign state (in the territory of which documents will be used).

Scheme (procedure) of consular legalization of documents drawn up in the territory of a foreign state:

  1. A competent authority of a foreign state;
  2. A diplomatic mission or consular office of the Kyrgyz Republic accredited in a foreign state;
  3. Consular Department of the Ministry of Foreign Affairs of the Kyrgyz Republic.

If documents were not legalized by a diplomatic mission or consular office of the Kyrgyz Republic:

  1. Accredited in the Kyrgyz Republic diplomatic mission or consular office of a foreign state;
  2. Consular Department of the Ministry of Foreign Affairs of the Kyrgyz Republic.

Documents that are not subject to consular legalization (cannot be legalized):

According to the "Regulations on the Procedure of Consular Legalization", approved by the Decree of the Government of the Kyrgyz Republic No. 60 dated 21 February 2011, the following documents are not subject to legalization (cannot be legalized):

  • Passports
  • Military Service Card
  • Work Record Cards
  • Driver's License
  • Certificates of Vehicle Registration
  • Trade Union Cards
  • Documents of belonging to social stratumand confessions

The documents that due to their content may harm the interests of the Kyrgyz Republic or contain information that offends the honor and dignity of its citizens are also not subject to legalization.

Important information!

According to the Conventions on Legal Assistance and Legal Relations in Civil, Family and Criminal Cases, signed in Minsk on January 22, 1993 and in Chisinau on October 7, 2002, documents issued or witnessed by a competent institution or specially authorized person within its competence in the prescribed form and sealed with the official seal is accepted in the territories of the following states without any special certificate (i.e., consular legalization is not required):

    • 1. Azerbaijan Republic;
    • 2. Republic of Armenia;
    • 3. Republic of Belarus;
    • 4. Georgia;
    • 5. Republic of Kazakhstan;
    • 6. Republic of Moldova;
    • 7. Russian Federation;
    • 8. Republic of Tajikistan;
    • 9. Turkmenistan;
    • 10. Republic of Uzbekistan;
    • 11. Ukraine.

Apostilization of documents.

Official documents executed on the territory of the member-states of the Hague Convention,abolishing the requirement on legalization of foreign documents dated 5 October 1961 (see the List of member-states of the Hague Convention) are certified by affixing the “Apostille” stamp by the relevant authorized state bodies of the Kyrgyz Republic and are released from legalization (except for documents executed by diplomatic or consular agents, and administrative documents of direct relevance to commercial or customs operation).

Important information!

The Hague Convention, abolishing the requirement on legalization of foreign documents dated 5 October 1961, does not apply between the Kyrgyz Republic and the following its member-states, due to the objection by these states regarding the accession of the Kyrgyz Republic to this Convention:

    • 1. The Republic of Austria;
    • 2. The Kingdom of Belgium;
    • 3. The Federal Republic of Germany;
    • 4. The Hellenic Republic.

Note: Documents for legalization are accepted from their owners. In case of absence of the owner of the Document, the Document is accepted against presentation of notarized Power of Attorney.
