THE DEMANDITION OF DOCUMENTS ON THE STATE REGISTRATION OF CIVIL STATE ACTS FROM A TERRITORY OF FOREIGN STATES

General information about the state service

Requesting documents on state registration of civil status acts from the territory of foreign states as part of the fulfillment of international obligations of the Russian Federation is carried out in accordance with international treaties signed and ratified by the Russian Federation, as well as by the state with which relations within the framework of international legal assistance are assumed:

* Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters, signed by member states of the Commonwealth of Independent States in Minsk on January 22, 1993

* Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters, signed by the member states of the Commonwealth of Independent States in Chisinau on October 7, 2002;

* Treaty between the Russian Federation and the Republic of Azerbaijan on legal assistance and legal relations in civil, family and criminal matters (Moscow, December 22, 1992);

* Treaty between the Russian Federation and the Republic of Moldova on legal assistance and legal relations in civil, family and criminal matters (Moscow, February 25, 1993);

* Treaty between the Russian Federation and the Republic of Latvia on legal assistance and legal relations in civil, family and criminal matters (Moscow, February 3, 1993);

* Treaty between the Russian Federation and the Republic of Lithuania on legal assistance and legal relations in civil, family and criminal matters (Moscow, July 21, 1992);

* Treaty between the Russian Federation and the Republic of Estonia on legal assistance and legal relations in civil, family and criminal matters (Moscow, January 26, 1993).

The state service for requesting documents on state registration of acts of civil status from the territory of foreign states is carried out in accordance with the Administrative Regulations for the provision of state services for the recovery of personal documents approved by the Order of the Ministry of Foreign Affairs of Russia and the Ministry of Justice of Russia of December 25, 2008 No. 20086/311.

The procedure for the provision of public services

1. The right to appeal for the reclamation of documents (repeat certificates, certificates) of state registration of acts of civil status from the territory of foreign states is held by the persons specified in paragraphs 2 and 3 of Article 9 of the Federal Law of November 15, 1997 No. 143-ФЗ “On Acts of Civil Status ", namely:

the person in respect of whom the record of the civil status act was made;

a relative of the deceased or another interested person in the event that the person in respect of which the previous record of the civil status act was made has died;

parents (persons replacing them) or a representative of the guardianship and custody agency in the event that the person in respect of whom the birth certificate was filed did not reach the date of issuance of a renewal certificate of majority;

another person in the case of a notarized power of attorney from a person who, in accordance with this article, has the right to receive a repeat certificate of state registration of an act of civil status.

Repeated certificate of state registration of a civil status act is not issued:

the parents (one of the parents) of the child for whom they are deprived of parental rights or are restricted in parental rights - the child’s birth certificate;

Persons who have dissolved a marriage, and persons whose marriage has been declared invalid, are issued a marriage certificate.

At the request of these persons, they are issued a document confirming the fact of the state registration of the child’s birth or marriage (certificate).

2. When requesting certificates (certificates) of state registration of acts of civil status from the territory of foreign states, applicants fill out a questionnaire for requesting documents on state registration of acts of civil status.

The application form for requesting documents on state registration of acts of civil status must be filled in by citizens in two copies for each document separately and must be signed by them. It is advisable to complete the questionnaire using a computer or typewriting technique, and if this is not possible, in legible handwriting. The address of the place of residence and location of the civil registry office should be indicated in full, including the index. If there is information, it is necessary to fill in all the boxes with as accurate information as possible, in particular, the name of the civil registry office in the territory of a foreign state; in the absence of data, it is necessary to indicate the reason in the additional information.

In case of loss of certificates of state registration of acts of civil status issued outside the Russian Federation, you must contact the registry office at the place of residence of the applicant

The document proving the identity of the applicant;

Receipt of payment of state duty for document retrieval;

Documents confirming the right to receive, if a document is requested to another person;

The term of the state service

The issuance of documents on the state registration of acts of civil status, drawn up by the competent authorities of foreign states is carried out after receipt of this document in the registry office at the place of residence of the applicant.

When issuing to citizens of repeat certificates and certificates of state registration of acts of civil status received from the territory of foreign states, the state fee for issuing a document is not charged.

Documents issued to applicants

Repeated certificate (certificate) of state registration of acts of civil status;

Notification of the absence of a record of the act of civil status, in cases where neither the first nor the second copy of the act record has been preserved, or the registration of the act of civil status has not been made.

e) if a criminal liability document is requested, then indicate the full and exact address of residence in Kyrgyzstan
