On January 17, 2023, by the Government of the Republic of Kazakhstan it is decided to change the rules for the entry and stay for foreign citizens from January 27, 2022.

According to the new rules:

- the period to stay for foreign citizens in the Republic of Kazakhstan, arrived in a visa free manner, ends in 30 calendar days from the date of crossing the state border of the Republic of Kazakhstan, totally 3 months in a 6 months period, unless otherwise established by agreement of the Republic of Kazakhstan with the respective party;

- for citizens of the member states of the Eurasian Economic Union, the period of stay ends - after 3 months from the date of crossing the state border of the Republic of Kazakhstan, totally 90 calendar days during 180 calendar days;

- if EAEU citizens intend to stay for more than 3 months within 6 months, it is needed to conclude an employment contract with the employer or obtain a temporary residence permit (TRP) or residence permit from the migration service. Citizens who have already received a TRP may stay until the end of its validity;

- if a citizen of the Kyrgyz Republic is one of the member of family, it is necessary to issue a temporary residence permit at the migration service due to family reunification.

After leaving Kazakhstan, a foreigner who has no other valid reasons for staying in the country will have a 90-day waiting period before he can cross the border back again.

It is particularly attentive that each arrival and departure will be summed up after 90 days, the waiting period for each entry will be another 90 days. At the same time, we note that arrival and departure without a temporary residence permit, an employment contract will be summed up.

In case of exceeding the established and permitted period of stay, the Border Guard Service of the Republic of Kazakhstan will restrict entry into the country.

The new restrictions do not apply to foreign citizens who arrived in Kazakhstan on a visa, and for those who have issued a temporary residence permit. For this category of citizens, the period of stay in the country is limited only by the period of validity of the document.

Currently, the competent authorities of the Republic of Kazakhstan are working on issues related to the procedure for calculating the duration of stay on the territory of the Republic of Kazakhstan, as well as the mechanisms for their application.

It is important to note that the new rules for entry into Kazakhstan will come into force on January 27, 2023.
