POSITION about consular fees for actual expenses

  1. Consular fees are money collected by the Ministry of Foreign Affairs of the Kyrgyz Republic and its representative offices in the Kyrgyz Republic (hereinafter referred to as the Ministry of Foreign Affairs), diplomatic missions and consular services of the Kyrgyz Republic abroad (hereinafter referred to as foreign agencies) for performing consular actions in relation to legal or individuals of the Kyrgyz Republic and foreign states.

  2. Consular fees are levied in accordance with the agreement that entered into force in accordance with the established procedure, of which the Kyrgyz Republic is a party, the legislation of the Kyrgyz Republic and this Statute.

3. Fees for actual expenses (actual expenses) are cash collected simultaneously with consular fees and sent for reimbursement of material costs incurred in performing consular actions of the diplomatic service of the Kyrgyz Republic.

4. In the absence of an overseas office of the Kyrgyz Republic in a foreign country, consular fees for consular actions are levied by a diplomatic mission or a consular office of another foreign country in that country in accordance with an agreement that has entered into force in accordance with the established procedure, of which the Kyrgyz Republic is a party. In these cases, consular fees are charged at rates, acting in these institutions, unless otherwise provided.
5. The heads of foreign institutions of the Kyrgyz Republic in the country of residence and the responsible officials of the Ministry of Foreign Affairs in the territory of the Kyrgyz Republic are personally responsible for the correct collection of consular fees and charges for actual expenses.

6. On the territory of the Kyrgyz Republic - foreign managers, in the foreign institutions of the Kyrgyz Republic - the head and accounting control over the correctness of insurance fees, are responsible for the timeliness and completeness of the payment of consular fees and charges for actual expenses on current accounts to the bank and their use according to estimates .

7. When consular actions are performed on the territory of the Kyrgyz Republic with actual expenses in accordance with the tariffs developed by the Ministry of Foreign Affairs in coordination with the relevant antimonopoly authorities of the Kyrgyz Republic.

8. When consular actions are performed abroad, fees for actual expenses are in accordance with the tariffs developed by the foreign institutions depending on the country of residence and approved by the Ministry of Foreign Affairs for each foreign institution of the Kyrgyz Republic separately.

9. Material costs are understood to be expenses incurred in consular activities:

- postage, telegraph, telephone, transport, stationery and any other overhead costs associated with consular activities;

- other expenses related to consulates, including storage and retrieval of property, its sale, as well as the promotion of trade and economic relations.

10. MFA, depending on the size of material costs, can lower or raise tariffs for actual expenses, in agreement with the relevant antimonopoly authorities of the Kyrgyz Republic.

11. Citizens of the Kyrgyz Republic - persons who have not attained the age of 16, retired persons and persons over 60 years old are exempted from paying consular fees by 50 percent.

12. Persons who are ethnic Kyrgyz who are citizens of foreign states are exempted from paying consular fees and charges for actual expenses when returning them to their historic homeland for permanent residence.

18. In accordance with international practice and on the principles of mutual consular fees, they are brought to the attention of the Ministry of Foreign Affairs.

The heads of foreign institutions of the Kyrgyz Republic and the head of the consular service of the Ministry of Foreign Affairs are granted the right to a reasonable written declaration on refusal to participate in consular fees or to fully release citizens of the Kyrgyz Republic from payment in the following cases:

- when issuing a certificate of return;

- at registration of marriage registration and issuance of notarial documents;

- when translating and legalizing documents for the poor

- in other cases that will be recognized as respectful heads of foreign institutions of the Kyrgyz Republic or head of the consular service of the Ministry of Foreign Affairs, in particular, such cases as illness, difficult financial situation, accident, etc.

21. Consular fees and charges for actual expenses are indicated: 1) in the national currency of the Kyrgyz Republic when consular actions are performed in the territory of the Kyrgyz Republic; 2) in US dollars when committing consular actions at the foreign institutions of the Kyrgyz Republic and at the consular posts of the Foreign Ministry located at the international border crossing points of the Kyrgyz Republic.

Collection of consular fees and charges for actual expenses on the territory of the Kyrgyz Republic in the national currency of the Kyrgyz Republic, except for consular posts located at the international border crossing points of the Kyrgyz Republic. 23. The collection of consular fees and charges for actual expenses in the overseas agencies of the Kyrgyz Republic is made in the currency of the host state. 24. Consular fees are not charged: 1) if there is an agreement between the Kyrgyz Republic and a foreign state on the mutual refusal to collect consular fees; 2) if there is an agreement between the Kyrgyz Republic and other organizations on exemption from consular fees; 3) in cases of repatriation of Kyrgyz citizens; 4) for the issuance and processing of diplomatic and official passports; 5) at registration of the outputs of officials of the state, government and parliamentary delegations of the Kyrgyz Republic;

6) when registering the entry into the Kyrgyz Republic of officials of foreign government, government, parliamentary delegations;

7) when registering the entry of foreign citizens into the Kyrgyz Republic on issues of economic, humanitarian or other assistance of the Kyrgyz Republic (only in the case of the provision of documents: contracts, charters, etc.);

8) for investment visas for investors upon presentation of confirmation from the competent authority of the Kyrgyz Republic in the field of economic regulation;

 9) when issuing diplomatic and service visas, except when they are subject to consular fees on the terms of reciprocity;

10) when making trips abroad for official business of employees of state organizations;

11) when legalizing documents at the request of state budget organizations;

12) in other cases, data of the legislation of the Kyrgyz Republic.

25. The procedure for the use of funds, from the deduction of consular fees, as well as the procedure and form of reporting on them, are regulated in accordance with the regulatory legal acts of the Kyrgyz Republic. The manager of the consular funds, within the approved budget, is the Ministry of Foreign Affairs of the Kyrgyz Republic, as the head of the budget institution, which has the right to dispose of budget allocations.
